Madhya Pradesh: Children file complaint against parents for restricting use of mobile phones, TV; High Court stays trial

The Indore bench of the Madhya Pradesh High Court has stayed the trial court proceedings in a case filed by children against their parents for restricting the use of mobile phones and television.

A brother-sister duo, an eight-year-old boy and a 21-year-old girl, filed a complaint against their parents at the Chandan Nagar police station in October 2021, alleging that their parents were prohibiting them from using their mobile phones and watching television during the lockdown period.

The police arrested the parents and also submitted the case in the district court. Recently, the children’s father Ajay Chouhan filed a petition in the Indore District High Court seeking dismissal of the case under Section 482 of the Code of Criminal Procedure.

“A 21-year-old girl and her eight-year-old brother had lodged an FIR against their parents at Chandan Nagar police station in Indore in October 2021. The police had registered a case under sections 323, 342, 506 and 34 of the Indian Penal Code (IPC) and sections 75 and 82 of the Juvenile Justice (Care and Protection of Children) Act,” said Dharmendra Chaudhary, lawyer on behalf of the parents.

The children alleged that their parents were harassing them, depriving them of food and forbidding them from watching television, especially using mobile phones. There were other problems at home too. Due to this, the children went to stay with their aunt (Bua) and after that, they filed a complaint. After completing the investigation, the Chandan Nagar police presented the challan in the district court, Chaudhary said.

“Recently, the main accused in the case, the children’s father Ajay Chouhan, had filed a petition before the Indore High Court under Section 482 of the Code of Civil Procedure in this matter. During the hearing on July 25, the high court stayed the proceedings of the trial court,” he said.
